Liability Management and Litigation Going into Chapter 11
Debtors are increasingly focusing on pre-default and pre-bankruptcy “Liability Management” transactions, including, collateralizing and maxing out draws on existing debt, transferring assets to unrestricted affiliates, releasing guarantees and liens--all preparing Debtors for negotiating and effecting desired Chapter 11 restructurings, while often leading to litigation challenges. Changes on the Far Eastern Horizon: What Do Political and Policy Changes Portend for Distressed Investing in Asia?
Corporate bond defaults in China have hit a record high, and the government also seems to be adjusting its political and policy approaches to its substantial property market, as seen in the Evergrande, Fantasia, and Sinic matters, indicating that the government may be working to try and control the runaway growth of debt. What does this mean for folks in our industry, both on the restructuring and the investing sides, and how likely are these near-term trends in the Far East likely to spread to other economies and areas in Asia?

The Ongoing Impact of COVID-19 on the Hospitality Industry and Distressed Assets
Between governmental restrictions on travel, the world transitioning to zoom meetings, and prohibitions against large indoor gatherings, owners and investors in the hospitality industry have suffered great losses during the pandemic.  Our experts will discuss the impact of COVID on the hospitality industry, including, the inability to project accurately when the industry will return to pre-pandemic levels and how this inability has created challenges in formulating valuations of these businesses (and distressed assets generally).

Investing in Distressed Healthcare Industry Assets: Just What The Doctor Ordered!
The healthcare industry represents almost 20% of GDP and presents opportunities for distressed investment across all sectors.  The global pandemic has caused tremendous financial challenges for the industry, including reductions in revenue from, among other things, cessation of non-emergency procedures, coupled with greatly increased costs, including from treating COVID patients and labor costs. Meanwhile, recent legal rulings with regard to the sales of distressed healthcare assets have also  increased the potential for maximizing value in a distressed acquisition.  This panel will discuss these issues, the current status of the various industry sectors as we emerge from the pandemic, and the “hot” sectors of the industry for distressed investing.
